Smith, Currie & Hancock's common sense construction law: a practical guide for the construction professional

The book is intended to serve as a practical introduction to the significant legal topics and questions affecting construction industry professionals, whether they work for general contractors, subcontractors, owners, or surety bond agents. It's not intended to cover legal theory or serve as a lawyers guide tocase law and commentary. The book's strength has always been its ‘common-sense’ approach, clear, unaffected writing and focus on writing for construction professionals rather than lawyers. The new edition is necessary due to a radical rewrite of the existing industry construction contracts produced by the AIA,AGC, EJCDC and others. In late 2007/early 2008 the AIA will be releasing a new set of construction contracts, while at the same time a new consortium of construction and engineering associations will be releasing a new set of contracts that will replace those currently pruduced by AGC. The new consortium is comprised of Associated General Contractors of America (AGC), Associated Specialty Contractors, Inc. (ASC), American Subcontractors Association, Inc. (ASA), Construction Industry Round Table (CIRT), Construction Owners Association of America (COAA), Construction Users Round Table (CURT), Design-Build Institute ofAmerica (DBIA), National Association of State Facilities Administrators (NASFA), National Association of Surety Bond Producers (NASBP); and the Surety & Fidelity Association of America (SFAA). The intent of the new consortium-produced contracts is to simplify the contracting process for contractors and engineers and provide a strong alternative to the revised AIA contracts. Concurrent with these efforts, EJCDC is also updating their agreements which are produced in alliance with ASCE. Tom Kelleher and his colleagues will thoroughly review the multitude of new agreements and offer advice for migrating to the new forms, identify similarities between the old forms and the new, and highlight any issues or areas of concern in the new agreements. Samples of the new documentswill be provided on an accompanying CD for ease of reference.
